Terms and Conditions of Service
General Considerations
By contracting our services, the client acknowledges working with a professional. Therefore, any suggestion or special request regarding content or project information must be communicated during the briefing or preliminary meetings.
Communication and Trust
We value clear communication and mutual trust with our clients. However, we emphasize that we operate thoughtfully and objectively, with decisions grounded in data, analysis, and a strategic approach. Our creative and operational decisions align with the objectives discussed and agreed upon prior to the contract with the client.
Service Scope
Our primary service is Web Design, delivered through our flagship offering, Webs 360, a comprehensive, done-for-you web design and digital infrastructure package.
Graphic Design, Content Design, and Creative Visual Communication are offered as accessory (complementary) services to support the Webs 360 package. These accessory services are delivered through vetted third-party creative professionals, coordinated and quality-controlled directly by the service provider (see “Outsourcing and Third-Party Contracting” below).
The client should fully understand the benefits these services offer for their brand and business. We encourage clearing any doubts or confusion before contracting any service.
Deadlines
Delivery dates are approximate and may vary. While the established timeline is typically sufficient, clients should consider various factors that might affect delivery times.
Revisions and Modifications
– Up to two (2) rounds of revisions are allowed within five (5) non-transferable, non-deductible business days, as long as they relate to the concept defined in the brief and initial meetings.
– After two (2) revisions, each additional revision will incur a cost equal to 25% of the total project cost.
– If the requested changes involve a concept modification or a complete redesign of the piece or project, an additional charge between 33% and 77% of the total project cost will apply.
Process
All our services follow a three-phase process: Project Description and Conceptualization, Brainstorming, and Design, Polishing, and Editing. During the final stage, content programming may be included if necessary.
During the conceptualization phase, a meeting with the client will be held to clarify any questions and collect visual references. Subsequently, research is conducted to support the visual solutions and decisions for the project.
Project Start and Payment
– Every project begins upon confirmation of full payment or 70% of the total cost. The timeline starts from this point.
– By contracting our services, the client agrees that no refunds will be issued at any stage or phase of the design and/or development. We recommend ensuring confidence in your purchasing decision.
– The client has a maximum of three (3) business days to request any refund. Note that no case will allow a 100% refund. $20 or 7% of the total amount will be retained for operational, tax, and payment gateway fees. Refunds are not processed on weekends and may take up to 30 business days if immediate processing is unavailable.
No-Litigation Clause
The client agrees to waive any legal claims or disputes against the service provider in the event of dissatisfaction with the service, committing to resolve any issues through mutual dialogue.
Design Style
It is a common misconception that graphic designers can work in all design styles. Although we may have versatility, this does not mean that we handle every style with the same speed and efficiency, and it may require additional time. For this reason, designers and other creatives showcase their portfolios to reflect their specific skills and unique design styles.
Project Tracking and Notifications
The client will have access to a dedicated project tracking plugin, built specifically for the project, which centralizes progress updates, phase status, and notifications in real time.
This tool replaces informal check-ins as the primary source of project status. We encourage a healthy and transparent work culture between client and service provider; therefore, we recommend avoiding unnecessary pressure or micromanagement.
Working Hours
Saturdays after 5 PM EST (US) and Sundays are non-working days, and we do not take calls or answer inquiries about the project. Clients can check updates through the project tracking plugin.
Communication Point of Contact
The client must designate a communications contact to provide any additional information required by the service provider about the brand or project.
File Storage and Access
Editable and deliverable files for each project will be stored for a maximum of three months after final project delivery. We recommend taking precautions and saving copies on preferred devices. After this period, all files and traces will be permanently deleted and will not be recoverable. If located on an external drive owned by us, a special fee will apply for locating and sending the files.
Web Design — Webs 360
As our primary service, Web Design includes the following optional add-on: monthly maintenance and plugin updates, available for an additional fee of $30 USD per month. The client is not required to purchase this service. If acquired, a monthly invoice will be sent for maintenance.
Outsourcing and Third-Party Contracting
– For large-scope projects, including but not limited to Webs 360 packages, the service provider may engage third-party creative professionals or teams to support delivery.
– All third-party professionals are personally filtered and selected by the service provider to guarantee the quality standards of the project.
– If requested by the client, the selected professional or team may participate in an interview with the client’s designated contact. The final decision on team composition remains with the service provider.
– Accessory services (Graphic Design, Content Design, and Creative Visual Communication) may be fulfilled entirely or partially through this outsourcing model.
Retained Contract (Outsourcing for 360 Projects)
For clients requiring ongoing creative support across a full Webs 360 engagement, we offer a Retained Contract: a dedicated creative team, curated and supervised by the service provider, retained on a recurring basis for the duration of the project or a defined term.
– Scope, team composition, and monthly retainer fee are defined in a separate agreement specific to the Retained Contract.
– The Retained Contract does not replace this Terms and Conditions document; it operates as a supplementary agreement subject to these same general terms.
– The service provider retains final authority over quality control and team assignment under the Retained Contract, consistent with the Outsourcing and Third-Party Contracting clause above.

– Service Provider: The individual or entity providing the services.
– Service: The specific design or creative communication services provided.
– Project: The contracted work scope agreed upon by the service provider and the client.
– Payment Gateway: The online platform used for processing transactions.
– Payment Method: The form of payment agreed upon (e.g., bank transfer, credit card).
– User: The individual designated by the client to access certain services or assets.
– Change and Revision: Any modifications or updates made to the original project.
– Graphic Design, Branding, Consulting, Content Design, and Creation: The service provider offers various forms of creative services, focusing on the client’s visual and content solutions.
– Webs 360: The service provider’s flagship, primary service offering — a comprehensive, done-for-you web design and digital infrastructure package.
– Outsourced Professional: A vetted third-party creative professional or team engaged by the service provider to support accessory services or large-scope projects.
– Retained Contract: A recurring engagement in which a dedicated, curated creative team is retained to support a client’s ongoing Webs 360 project.
